(the "Provider")
The Provider is not a VAT payer.
The subject of the contract is the creation of a custom website according to the specification agreed between the Provider and the customer (the "Customer"). The specific scope of services is defined by the chosen package (Business Card, Presentation, Premium) and any individual adjustments.
The contract is concluded the moment the Customer confirms the order (by e-mail, phone or via the contact form) and the Provider accepts it. The Provider confirms receipt of the order by e-mail.
The price is agreed individually according to the scope of the project and is stated in the offer confirmed by the Customer before work begins. The Provider is not a VAT payer. Domain and hosting are not included unless agreed otherwise.
Payment is made on the basis of an invoice. For the Presentation and Premium packages a deposit of 50% is required before work begins, with the balance due after handover. For the Business Card package, payment is made once, after handover.
Invoices are payable within 14 days of issue. Prices are quoted in EUR; for customers in the Czech Republic the price may be invoiced in CZK at the equivalent amount.
The Provider undertakes to deliver the work within the timeframes stated for each package (approximately 5–14 working days), provided the Customer supplies all materials on time. Failure to supply materials by the Customer may extend the delivery time.
The work is considered handed over the moment the Provider makes the finished website available to the Customer and the Customer accepts it in writing (by e-mail).
The Customer undertakes to supply the Provider with all materials needed to create the website (texts, photographs, logo, etc.) within the agreed deadline. The Customer is responsible for ensuring that the supplied materials do not infringe the rights of third parties.
The Provider undertakes to carry out the work with professional care and in accordance with the agreed specification.
Upon full payment of the price of the work, the Customer acquires the right to use the website without restriction. The Provider reserves the right to feature the work in its portfolio as a reference, unless the Customer objects.
The source code created by the Provider becomes the property of the Customer upon payment.
The Provider provides a warranty on the functionality of the website for a period of 3 months from handover. The Customer must submit a complaint by e-mail to infomistrovskyweb.cz. The Provider undertakes to assess and resolve the complaint within 14 working days.
A Customer who is a consumer has the right to withdraw from a contract concluded by distance means within 14 days of the conclusion of the contract, without giving a reason, in line with EU consumer protection law (Directive 2011/83/EU). If, at the Customer's express request, the Provider has already begun performance, the Customer is obliged to pay the proportionate part of the price for the services already provided.
Withdrawal from the contract must be sent by e-mail to infomistrovskyweb.cz.
The Provider is not liable for damage caused by incorrect materials supplied by the Customer, by outages of third-party services (hosting, domain) or for the Customer's lost profit.
These terms and conditions are governed by the law of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection, while respecting the mandatory consumer protection rules of the country in which the consumer Customer has their habitual residence within the EU.
Any disputes will be resolved primarily by agreement. The competent out-of-court body for the resolution of consumer disputes in the Czech Republic is the Czech Trade Inspection Authority (www.coi.cz).
The Provider reserves the right to amend these terms and conditions. The current version is always available at mistrovskyweb.cz.
